We understand the interplay between Social Security claims and Montana workers’ compensation claims.  Montana is one of the minority of states that is a “reverse offset” state with regard to Social Security Disability benefits.  This means that the workers’ compensation insurer, and not the Social Security Administration, is entitled to an offset when a claimant is eligible for both Social Security Disability and total disability benefits from the workers’ compensation insurer.  However, national processing centers for Social Security benefits often calculate and take the offset in error.  We are experienced local attorneys who know how to correct offset errors.
